Terms of Service

1. Agreement

By using the services of Flag Avenue ("Joseph Ubani"), you agree to abide by the following terms and conditions. These terms constitute a legally binding agreement between you (the "Client") and the Photographer.

2. Services

2.1. The Photographer/videographer will provide services as described in the Client's order.

2.2. The Client is responsible for providing accurate information, including event details, location, and schedule.

3. Payment

3.1. The Client agrees to pay the Photographer/videographer the total amount specified in the order.

3.2. Payment can be made through Pixieset's payment processing system or any other method agreed upon by both parties.

4. Cancellations and Rescheduling

4.1. Cancellations by the Client must be made in writing and are subject to the Photographer/videographer's cancellation policy as outlined in the order.

4.2. The Photographer/videographer reserves the right to reschedule or cancel services due to unforeseen circumstances. In such cases, the Photographer will make reasonable efforts to provide an alternative date or a refund.

5. Copyright and Usage

5.1. The Photographer/videographer retains copyright ownership of all images taken during the session.

5.2. The Client may use the images for personal, non-commercial purposes only. Any commercial use requires prior written consent from the Photographer.

6. Delivery

6.1. The Photographer/videographer will deliver the final edited images to the Client within the timeframe specified in the order.

6.2. Delivery may be in digital format via Pixieset or any other method agreed upon.

7. Image Retention

7.1. The Photographer/videographer will retain the edited images for a minimum of 60 days. After this period, the Photographer/videographer may delete the images.

8. Client Cooperation

8.1. The Client agrees to cooperate with the Photographer/videographer to ensure the success of the session, including following any guidance provided by the Photographer/videographer.

9. Liability

9.1. The Photographer/videographer is not liable for any loss, damage, or injury to persons or property during the session, unless caused by the Photographer's gross negligence.

10. Privacy

10.1. The Client's personal information will be kept confidential and will not be shared with third parties without the Client's consent.

11. Governing Law

11.1. These terms and conditions are governed by the laws of the local jurisdiction where the service will be provided, and any disputes shall be resolved in accordance with those laws.

12. Amendments

12.1. The Photographer/videographer reserves the right to amend these terms and conditions at any time. Any changes will be communicated to the Client in writing.
